This Disclaimer and Acceptable Use Policy have been created by Audio Visual Archives (AVA) to promote the integrity of AVA services, and customers. AVA reserves the sole right to modify this Disclaimer and Acceptable Use Policy at any time and in any way it deems necessary. Notification of changes or amendments to this document will be posted on this site.

This policy shall be effective upon the establishment of the Customer contract and will remain binding until the cessation of services by either party. Throughout the term of its Agreement with AVA, the Customer must ensure that the use of AVA services and products conforms to AVA Acceptable Use Policy. These policies supersede any agreements previously made with AVA be it written or oral.

1. Acceptable Use:

The Service may be used only in a manner that, in AVA sole discretion, is consistent with the purposes and ethics of such Service. Customers should contact AVA if unsure of whether any contemplated event to be recorded or broadcasted is permitted. The usage of AVA services must comply with current laws and regulations, Including but not limited to regulations pertaining to copyright, license agreements and patents.

Subscriptions purchased online, directly via this website are expressly for the use of individuals and are in no way permitted for commercial use or mass viewing or distribution unless otherwise specified by Audio Visual Archives Pty Ltd.

2. Unacceptable Use:

By way of example, and not limitation, the following sections outline activities that are expressly prohibited.

The Service shall not be used to broadcast material which, in the judgment of AVA:

a) Violates local, state, federal, foreign, or International Law;

b) Could be considered threatening, obscene, indecent, defamatory, threatening or that otherwise could adversely affect any individual, group or entity.

c) Deceptive or fraudulent practices.

d) Any activity infringing on the intellectual property rights of others, including, but not limited to, copyrights, trademarks, service marks, trade secrets, patents. Actions that restrict or inhibit any Person, whether a customer, AVA, or otherwise, in its use or enjoyment of any AVA Service.

e) The engagement of AVA services to promote deceptive and or illegal marketing practices, products or services.

f) Advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material.

g) Uses AVA services as a means to transmit or post defamatory, harassing, abusive, or threatening language.

h) Engage in activities, whether lawful or unlawful, that AVA determines to be harmful to its clients, operations, reputation, goodwill, or clients relations.

i) Content available on this website is not to be mass downloaded and stored for access at a later date.

j) All materials available on this website are not to be reproduced or made available by other means without the explicit and written consent of the publisher.

3. Obligations

Password Protection:
Due to the public nature of the Internet, all information should be considered publicly accessible, and important or private information should be treated carefully. AVA is not liable for protection or privacy of broadcast transferred throughout the Internet or any other network AVA or its customers may utilise.

The Customer is responsible for protecting passwords provided by AVA. All actions resulted from passwords being compromised will remain the sole responsibility of the Customer.

Content Protection:
The Customer must provide appropriate protection to prevent minors (persons under 18 years of age) from accessing any unsuitable material broadcasted via AVA.

Content Ownership:
The Client is responsible for all content or information residing on or transmitted via the Service.

4. Technical Disclaimer

AVA does not warrant that the broadcasts will be uninterrupted, error-free, or completely secure. AVA does not and cannot control the flow of information to or from AVA's server and other portions of the internet. Such flow depends in large part on the performance of Internet services provided or controlled by third parties. At times, actions or inactions of such third parties can impair or disrupt AVA and/or clients connections to the internet (or portion thereof). AVA cannot guarantee that such events will not occur. Accordingly, AVA disclaims any and all liability resulting from or related to such events.

5. Third Party Complaint Process

If Customer, or the public, wishes to notify AVA of a potential violation of this acceptable policy they should do so by sending an e-mail to AVA

AVA will review such communication as quickly as possible and take action as deemed appropriate by AVA.

6. Enforcement

AVA reserves the right to immediately, and without prior notice block, suspend, and/or terminate access to the Service at any time for any conduct that AVA, in its sole discretion, determines violates, or may violate this acceptable use and obligations policy of AVA or is otherwise harmful to AVA's interests or the interests of others. AVA reserves the right to immediately notify any relevant authority when deemed necessary.
